(2.1)     Creation of contractual posts

(2.1.1)  In accordance with the decision of the Governing Body of the C.S.I.R

    The Posts of scientists 'B' and above are contractual posts and appointments to these posts are made on contractual basis.  The incumbents of such posts are given contract for a period of 6 years in the first instance and after a period of 5 years, the incumbents are given option to be confirmed against permanent posts, if permanent posts in the cadre are available or they are allowed to continue on further contract.

Such contract-posts fall under the following two cadres:-

  1. (Those created for regular establishment of the Labs./lnstts.
  2. Those created for the specific projects/schemes for specified periods.

 The posts under the cadre (i) are created in the first instance on a temporary basis and since the incumbents to these posts are to be appointed on contract for a period of 6 years, these posts are to be taken as created for a period of 6 years, and their renewal on year to year basis is not necessary.  These posts are brought on permanent footing with the concurrence of Financial Adviser of Council of Scientific and Industrial Research in accordance with the established procedure for conversion of temporary posts into permanent.  The incumbents who are appointed on contract for a period of 6 years in the first instance are considered for confirmation against such permanent posts available or they have also the option to continue on contract for further period, subject to fulfilment of conditions as may be required from time to time.

In the case of temporary posts under cadre (ii) above created for specified projects/schemes for specified period, these posts are to exist for that specified period and the incumbents against such posts cannot be given normal contract for 6 years but their period of contract will only be for the specified period for which the schemes/projects are sanctioned.

The above clarifications are issued to enable the Laboratories/Institutes to follow uniform procedure in the matter of creation and renewal of contractual posts and offering of contractual appointments.

 (2.1.2)    Clarification regarding creation of contractual posts.

  1. The Contractual posts against which an officer having been appointed on a contract for 6 years resigns/gets transferred or promoted before the expiry of the full contractual term, needs sanction of the competent authority for a full term of another six years from the date a new incumbent is appointed against the same.
  2. ii & iii)

     

    All such contractual posts against which permanent employees are officiating should be deemed to have been created for a period of 6 years and the approval of the Executive Council may be taken to that effect.  The same procedure will apply if or when a contract officer is subsequently confirmed in a lower post.

  3. Contractual posts are deemed to have been created for a period of 6 years from the date it is filled.  However we shall be able to give clearer replies, if specific cases are sent to us.

      1. Under the orders in O.M. No.21/2/63-MP dated 24th August, 1963, the following categories of personnel are eligible for appointment to supernumerary posts:
    6. All Scientists and Technologists studying or working abroad;
    7. All Officers working in the Scientist Pool and
    8. All Scientists and Technologists who have recently returned from abroad but are not working in the Pool or elsewhere.
    9. The tenure of an appointee, to a supernumerary post should not ordinarily exceed two years;
    10. All organisations which are considered suitable for the placement of Pool Officers at present and which are doing scientific and/or research work should be considered as empowered to create Supernumerary posts.  This would hold good even if the organisation as a whole is not primarily concerned with scientific and/or research work but only a few posts therein are meant for such work.  In cases where there is any doubt regarding the eligibility of a particular organisation to create supernumerary posts, the matter may be decided in consultation with the Ministry of Home Affairs (Directorate of Manpower).
    11. It is requested that the above clarifications may please be communicated, for information and necessary action, to all scientific Institutions and Public Sector Undertakings with which the Ministry of Defence etc. are concerned.
    12. The task for which services of a specialist/outstanding scientist are required should first be identified by the Head of the Institution/ Research Laboratory.
    13. When a suitable scientist is selected for performing the task referred to above, the Head of the Institution should state how the qualifications and experience of the selected candidate would match that work.
    14. The Head of the Institution/Research Laboratory should certify that the candidate being recommended by him possesses such qualifications and experience that in his view he would be able to walk through any selection for regular appointment to a similar post.
    15. The Head of the Laboratory/Institute should also give a specific recommendation whether the Scientist is considered outstanding or not.
    16. If some scientist has failed to make the grade for regular appointment through the UPSC or otherwise, normally he should not be considered for appointment against any supernumerary post except when there are some over-riding considerations.
    17. At the time of framing budget estimates an amount which is considered reasonable in the light of the actual experience gained till then should be provided specifically for creation of supernumerary posts.  The quantum of this amount should be reviewed in the light of actual experience from year to year.
    18. Five copies of the Bio-data of the Scientist(s) concerned (These are necessary for reference to the Experts to whom the proposal is sent for perusal and recommendation).
    19. The post proposed to be offered to him and the initial pay recommended.
    20. Names of 2-3 referees who are eminent persons in the field of specialisation of the candidates and who are not connected with the organisation.
    21. Whether funds are available for this purpose.
    22. The number of supernumerary posts already sanctioned for the Laboratory/Institute and in operation (with dates)
    23. Scales of pay, name of discipline etc. for such posts already in operation.
    24. The immediate purpose for which the new appointment is recommended i.e. relevance to the research projects on hand to be indicated.
    25. Whether adequate provisions exist in the sanctioned budget of the Laboratory/Institute for meeting the expenditure on the supernumerary posts proposed  to be created.
    26. Names of two to three Experts to whom reference could be made if necessary on the work of the scientists recommended
